EXTRA TERRITORIAL EXEMPTIONS
This presentation will discuss the presumption against the extraterritorial application of law of one sovereign state into territory controlled by another sovereign state. Kiobel v. Royal Dutch Petroleum Co., 133 S. Ct. 1659, 185 L.Ed.2d 671, 81 USLW 4241 (U.S., 2013), a new unanimous case under the Alien Tort Statute will be reviewed. The concept of extraterritoriality in 522 will be discussed along with the suggestion that there may be property that cannot really be exempt. Additionally, the Cappelli case will be reviewed.
