PROPOSED AMENDMENTS TO RULES OF PROFESSIONAL CONDUCT FOR INSURANCE LAW AND OTHER PRACTITIONERS

On April 24, 2014, the Supreme Court of Appeals of West Virginia approved significant revisions to the West Virginia Rules of Professional Conduct and ancillary rules for a public comment period ending on June 13, 2014. If approved, nearly every Rule of Professional Conduct and/or official comment will be amended. This presentation will focus on the impending rule changes with the greatest impact on insurance law and other civil litigation practitioners, including changes to the procedures for securing waivers of conflict; retaining or contracting with other lawyers; ghostwriting; planning for assumption of clients upon a lawyer’s death or disability; keeping clients fully informed; preventing client fraud or criminal conduct; and a number of other subject areas.
