The New West Virginia Self-Settled Spendthrift Trust: The Basics and Drafting Suggestions
Effective June 8, 2016, West Virginia now permits asset protection trusts to be established with the benefit of creditor protection for a settlor who retains an interest in trust, provided certain requirements are met. This presentation will explore the legislative history, statutory requirements, effect of the creation, and drafting suggestions of the trust, which include the qualified affidavit and the trust agreement.
